Financial Security Services Celebrates 15th Anniversary

This year, NBFAA Associate Member Company Financial Security Services Inc. (FSS) celebrates its 15th anniversary in the security industry. FSS has specialized in providing term loan and line of credit financing, as well as billing services, to independent alarm dealers since its inception in 1990. The company added UL, FM, and IQ certified monitoring services through a subsidiary, Securion Central Control, in 1998.

Why Join an Alarm Association?

I am often asked, "Why should I join the alarm association?"

One reason (of many good reasons) is that YOUR alarm association is there to protect you and your business.

Case in point: The Suffolk County Legislature held a public hearing on February 15, 2005, for a bill titled "A Local Law Establishing Standards And Controls For Alarm Systems That Require Police Department Response." You can read the entire bill online at www.co.suffolk.ny.us. Look for resolution 1003-2005.

This bill would impose police department charges from $350 up to $1,000 including a misdemeanor charge resulting in a fine of an additional $1,000 or imprisonment for not more than one year.

This local law, if passed, could have put a serious kink in the alarm industry and would affect alarm dealers in Suffolk and Nassau Counties and also New York City alarm dealers who do business in Suffolk County.

The Long Island Alarm Association (LIAA) sprang into action. The word got out and members and officers of the LIAA as well as members and president of the Metropolitan Burglar and Fire Alarm Association (MBFAA) showed up at the legislative public hearing - about 15 in total.

Members and officers of the LIAA spoke before the legislature and were so articulate and convincing that the legislature indicated to the Suffolk County Chief of Police that his office and the Executive Office should work with the LIAA and restructure the bill to better meet the needs of Suffolk County, its residents and businesses, and the alarm industry.

So why join an alarm association?

  • They keep you up-to-date on legal and contractual issues.
  • You can readily exchange thoughts, ideas, and questions with your peers.
  • And as proven on February 15, 2005, at 2:30 p.m., in Suffolk County, N.Y.: WE ARE STRONGER TOGETHER THAN SEPARATE.

Alarm Contracts with a Husband and Wife

Question:
Suppose we have a contract with Mr. and Mrs. Smith. Both names are on the contract but only Mr. Smith signs it. If he moves out a year later, and she wants the accounts put into her name, do we need a new contract from Mrs. Smith?

Answer:
You need to have your subscriber sign your contract, and for residential that includes the husband and wife. To specifically answer your question, you should get the wife to sign the old contract or get her to sign a new contract.

You will find that if you are trying to enforce your contract, say on a collection case, you will only be able to hold the party who signed the contract, not a spouse living in the house. However, if there is a loss and you are defending yourself, you will find that the non-signing spouse will claim rights under the contract as an intended beneficiary. Even thought the contract may say that there are no "intended beneficiaries" you will find Judge's that will ignore the provision and permit the non signing spouse to claim rights under the contract or even worse, pursue a claim against you without relying on the contract, but just on the fact that you installed an alarm and monitored it. In other words, looking for all the benefits of the alarm system without you being able to rely on the protective provisions of the contract.

Bottom line, husband and wife should sign the contract if possible.
